1. Agreement
These Terms of Use (“Terms”) apply to the Order Kitchen mobile app and website operated by [Your legal business name] (ABN [00 000 000 000]) (“we”, “us”). By using the app you agree to these Terms and our Privacy Policy. If you use the app for a business, you confirm you are authorised by that business.
2. The service
Order Kitchen lets restaurant owners and staff view and manage online orders, table reservations, customer enquiries, products, menus and store settings for stores connected to our platform. Features may change as we improve the service.
3. Accounts
- Accounts are issued to businesses and their authorised staff. Keep your password confidential; you are responsible for activity under your account.
- Tell us promptly at support@orderkitchen.com.au if you suspect unauthorised access.
- The business that requested your account may ask us to change or remove your access.
4. Business responsibilities
Each restaurant business is responsible for its menu, prices, opening hours, food safety, allergen information, order fulfilment, refunds and dealings with its customers, and for complying with laws that apply to it, including the Australian Consumer Law and privacy laws for its customers’ information.
5. Acceptable use
You must not:
- access stores or data you are not authorised to access;
- interfere with, reverse engineer or attempt to bypass security of the app or its services;
- upload unlawful, misleading or infringing content (including images you don’t have rights to);
- use the app to send spam or harass customers.
6. Your content
You keep ownership of the content you upload (such as product photos and descriptions). You grant us a licence to host, display and process it only to provide the service to your business.
7. Fees
The app is free to download. Use of the Order Kitchen platform by a business is subject to the fees and terms agreed separately with that business.
8. Intellectual property
The app, website, software, design and the Order Kitchen name and logo are owned by us or our licensors. You may use the app only as permitted by these Terms.
9. Availability
We aim for the service to be available at all times, but it may be interrupted for maintenance, updates or events beyond our control. Push notifications depend on third-party services and your device settings and may be delayed; please don’t rely on them as your only way to monitor orders.
10. Liability
Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot be excluded. To the extent permitted by law, we are not liable for indirect or consequential loss (including lost profits or orders), and our total liability in connection with the app is limited to resupplying the service or paying the cost of having it resupplied.
11. Termination
You can stop using the app and request account deletion at any time (see Delete your account). We may suspend or end access if you breach these Terms or if the business’s agreement with us ends.
12. Governing law
These Terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that State.
